A real question from the full analysis

This is how each question you miss appears in the report. The question, the right answer, the explanation and the source are real. The answer shown as yours is an example, not anyone's data.

A seller, grateful for a quick sale, hands salesperson Duarte a $1,500 check as a thank-you bonus. Duarte's broker is not aware of it. Which statement is correct under B&P 10137?

  • A The payment is lawful because the seller chose to give it, and a broker did not demand it
  • B Duarte may be paid for licensed work only through his broker, so the payment is a violation
  • C The payment is lawful if Duarte reports the bonus as income on his tax return each year
  • D The payment is lawful because the amount is less than $2,000 and is a one-time gift

Example answer, marked sure: A · Correct answer: B

B is correct. A salesperson may not accept compensation for activity requiring a license from any person other than the broker under whom he is licensed at the time. Licensees may share compensation, but it must be paid through the responsible broker, and the Commissioner may suspend or revoke a license for a violation. A, C, and D invent exceptions based on who starts the payment, tax reporting, or amount. Remember: all compensation for licensed acts flows through the broker.
