A real question from the full analysis

This is how each question you miss appears in the report. The question, the right answer, the explanation and the source are real. The answer shown as yours is an example, not anyone's data.

Mia's insurer pays an $8,000 collision claim after another driver runs a red light and hits her car. Which party may the insurer pursue to recover the amount it paid?

  • A Mia herself, because her car was the one involved in the crash
  • B Mia's agent, because the agent placed the policy that paid the claim
  • C The at-fault driver, or that driver's insurer, through subrogation
  • D No one, because paying the claim ends all of the insurer's rights

Example answer, marked sure: A · Correct answer: C

C is correct. TDI's glossary describes subrogation as the legal right of an insurance company to pursue another person's insurance company after that person caused a loss to the insurer's policyholder. The other driver caused this crash. A is wrong because Mia did not cause the loss. B is wrong because the agent did not cause the loss. D is wrong because paying the claim is what creates the right. Remember: after paying, the insurer steps into the insured's shoes against the responsible party.
